Penalties
First Offense - A fine of up to $1,000.00 and up to 1 year in jail.
Second Offense - A fine of up to $2,000.00 and up to 2 years in jail.
Subsequent Offenses - A fine of up to $3,000.00 and up to 3 years in jail.
While transporting a minor:
1st offense - a fine of up to $2,000.00 and up to 2 years in jail;
2nd offense - a fine of up to $3,000.00 and up to 3 years in jail;
and, third and subsequent offenses - a fine of up to $4,000.00 and up to 4 years in jail.
Any person convicted of a 2nd DWI within 3 years is subject to a mandatory minimum penalty of
(a) imprisonment for not less than 48 hours, or
(b) completion of not less than 80 hours of community service.
These penalties are mandatory and can not be suspended.
